Over the years, researchers of numerous fields have suggested different criteria and conventions for the transcription of oral samples. Current practice by workers who carry out transcriptions in the Spanish legal system is not standardized and does not follow any general criteria. Indeed, the standards followed by professionals in this context are characterized by their heterogeneity. This contribution highlights the benefits of adhering to a particular set of criteria and conventions agreed upon by 115 transcribers to make the transcription process (...) more efficient, improve its comprehension and add to the value of transcriptions as key documents within the legal system that may have a direct impact on the right of the parties involved. The meaning of the word shaman (of Tungus origin) has become obscured by numerous, increasingly different interpretations. The term has also been applied to practitioners who live outside Siberia, and are actually called by different names in their respective countries: bomoh in Malaysia, ma khi in Thailand, and tany-di in Singapore.Because I did not want to rely on secondary sources, I went to Southeast Asia to find contemporary shamans. Having started my research in 1960 I was able to witness, over (...) a thirty-one year period (during visits lasting from several months to a year), the continuation of shamanic traditions among different groups living in multiethnic and multi-religious societies. In this commentary, I emphasize some points about the context of these thoughts concerning the dialectic of nature and freedom and the social realm in which the connections of (...) affectivity and personhood are situated.As discussed in philosophical anthropology, the concept “person” involves both the human capacity for freedom and the legal status given to an individual in society. Nevertheless, even in its most intensive understanding as personality and lived freedom, human existence cannot be separated from its being natural (including being emotional). Moreover, being natural is the condition sine qua non for a free conduct of life. The dialectic of freedom and naturality is addressed by Rosfort and Stanghellini as “ontologic ambiguity” or, to use an older phrase, the structure of “homo duplex”. The aspect of passivity in human existence in which we are determined by our physiology, our environment, and our biography becomes visible. On the other hand, we also see the active dimension of personhood: the possibility to put ourselves into question, to relate to ourselves, to undergo change, and to invent ourselves anew. In the Plessnerian sense, the “ec-centric” nature of the human condition enables us to become active in this way. Plessner supplanted the dialectic between passivity and activity with his notion of Leidenschaft—passion. In the German word Leiden we find the double meaning of suffering and being passionate. Humans are bound to act between the spheres of nature and free will. They suffer from being in the world and can also be passionate by acting in this reality. Leidenschaft thematizes both passivity and activity as well as their unity. Human beings are passive through being dependent on their circumstances. They are passionate, however, when they reflect on these conditions or attempt to come to terms with them. From the dialectical understanding, a unique structure emerges as mutually conditioned, both active and passive. The “passionate man” (a term that Plessner uses to define humanity) synthesizes his being dependent on others with his own freedom to create himself. Passion can be understood as an enhancement of sensuality and spirituality in the context of the conditio humana: “Human reflectivity does not stop in front of sensuality but rather enhances it or weakens it—and both directions can be dangerous for sensuality.” (Plessner 1976, 167, author's translation). [End Page 273]With Kierkegaard, we have to express this even more intensively: a human being is not only shaped by the dialectic of freedom and nature, but—through living—is himself this dialectic. Thus, human personality and human freedom cannot be disconnected from the dimension of passivity that lies at the very heart of freedom. In Jacob Böhme's words, the human situation is that of Naturfreiheit—being free by and through its very own nature. Armed reprisals are the limited use of military force in response to unlawful actions perpetrated against states. Historically, reprisals provided a military remedy for states that had been wronged by another state without having to resort to all-out war in order to counter or deter such wrongful actions. While reprisals are broadly believed to have been outlawed by the UN Charter, states continue to routinely undertake such self-help measures. As part of the roundtable, “The Ethics of Limited Strikes,” this essay (...) examines the doctrine of armed reprisals in light of recent instances of states using force “short of war” in this manner. We argue that the ban on reprisals has been largely ignored by states, and that recent attempts to apply the laws of armed conflict to the cyber domain are further weakening this prohibition. We conclude that this is a potentially dangerous development that lowers the bar for resorting to military force, risking escalation and thereby further destabilizing the international system. This essay frames systemic patterns of mental abuse against women of color and Indigenous women on Turtle Island (North America) in terms of larger design-of-distribution strategies in settler colonial societies, as these societies use various forms of social power to distribute, reproduce, and automate social inequalities (including public health precarities and mortality disadvantages) that skew socio-economic gain continuously toward white settler populations and their descendants. It departs from traditional studies in gender-based violence research that frame mental abuses such as gaslighting--commonly (...) understood as mental manipulation through lying or deceit--stochastically, as chance-driven interpersonal phenomena. Building on structural analyses of knowledge in political epistemology (Dotson 2012, Berenstain 2016), political theory (Davis and Ernst 2017), and Indigenous social theory (Tuck and Yang 2012), I develop the notion of cultural gaslighting to refer to the social and historical infrastructural support mechanisms that disproportionately produce abusive mental ambients in settler colonial cultures in order to further the ends of cultural genocide and dispossession. I conclude by proposing a social epidemiological account of gaslighting that a) highlights the public health harms of abusive ambients for minority populations, b) illuminates the hidden rules of social structure in settler colonial societies, and c) amplifies the corresponding need for structural reparations. In addressing social issues, organizations have a responsibility to promote diverse participation, yet often struggle to harness the benefits of racial and gender diversity. Using a community-based participatory research design, with data collected over an 18 month field study, we examined how a social change organization, FoodLab, facilitated diverse collaboration. FoodLab aimed to grow a good food economy in Detroit, Michigan, through working with their members, local food entrepreneurs. We found that recurrent episodes of practicing dialogue catalyzed collaborative action around (...) multiple issues, including shared kitchens, licensing, and membership. Practicing dialogue included intentional convening, participatory devices, and collective language. While leaders set up the initial procedures and rules, leaders and members, together, enacted these structures. Through high quality interactions, participants developed additional resources, knowledge, motivation, and relationships. Across episodes of practicing dialogue, traces of high quality interactions supported sustained effort around social issues. Our findings demonstrate the dynamic aspects of organizational structure and individual action in working towards diverse collaborative action. (shrink)

First, I discuss the importance of recognizing different states of consciousness. Knowing how these states differ from each other and recognizing their specific qualities determines their use, increases our self‐knowledge, balances our behavior and adjusts our course of action. Second, 1 report on workshops conducted in the United States, Russia, Lithuania, and Estonia. The examples illustrate the nature of material retrieved during different states of consciousness. Despite the positive effects of including patients’ preferences into therapy on psychotherapy outcomes, there are still few thoroughly validated assessment tools at hand. We translated the 18-item Cooper-Norcross Inventory of Preferences into German and aimed at replicating its factor structure. Further, we investigated the reliability of the questionnaire and its convergence with trait measures. A heterogeneous sample of N = 969 participants took part in our online survey. Performing ESEM models, we found acceptable model fit for a four-factor structure similar (...) to the original factor structure. Furthermore, we propose an alternative model following the adjustment of single items. The German C-NIP showed acceptable to good reliability, as well as small correlations with Big-Five personality traits, trait and attachment anxiety, locus of control, and temporal focus. However, we recommend further replication of the factor structure and further validation of the C-NIP. (shrink)

Legal scholars’ interest in Shakespeare has often focused on conventional legal rules and procedures, such as those of The Merchant of Venice or Measure for Measure. Those plays certainly reveal systemic injustice, but within stable, prosperous societies, which enjoy a generally well-functioning legal order. In contrast, Shakespeare's first historical tetralogy explores the conditions for the very possibility of a legal system, in terms not unlike those described by Hobbes a half-century later. The first tetralogy's deeply collapsed, quasi-anarchic society lacks any (...) functioning legal regime. Its power politics are not, as in many of Shakespeare's other plays, merely latent, lurking beneath the patina of an otherwise functioning legal order. They pervade all of society. Dissenting from a long critical tradition, this article suggests that the figure of Henry VI does not merely represent antiquated medievalism or inept rule. Through Henry's constant recourse to legal process, arbitration and anti-militarism, the first tetralogy goes beyond questions about how to establish a functioning legal order. This article explores the extent to which the decision to invade Iraq in 2003 coheres with the normative precepts of liberalism as an international political theory. Beginning with a Lockean liberal theory of the state, this article first examines the evolution of international liberalism in order to identify the fundamental normative postulates of liberal theory as it pertains to international relations, especially regarding the use of military force. The article then advances two interrelated arguments: First, that the underpinnings of the (...) decision to invade Iraq embodied in the Bush Doctrine draw heavily from the liberal tradition, though still depart from it in important ways. Second, that the Bush Doctrine as manifested in the Iraq war reflects in many ways the liberal thinking that prevailed during the interwar years and is therefore susceptible to a similar charge of ‘utopianism’ that was leveled against interwar liberalism by E. In recent years postcolonial and decolonial feminisms have become increasingly salient in philosophy, yet they are often deployed as conceptual stand-ins for generalized feminist critiques of eurocentrism (without reference to the material contexts anti-colonial feminisms emanate from), or as a platform to re-center internal debates between dominant European theories/ists under the guise of being conceptually ‘decolonized’. By contrast, this article focuses on the specific contexts, issues and lifeworld concerns that ground anti-colonial feminisms and provides a brief survey of the literature. (...) The question whether AI systems have agency is gaining increasing importance in discussions of responsibility for AI behavior. This paper argues that an approach to artificial agency needs to be teleological, and consider the role of human goals in particular if it is to adequately address the issue of responsibility. I will defend the view that while AI systems can be viewed as autonomous in the sense of identifying or pursuing goals, they rely on human goals and other values incorporated (...) into their design, and are, as such, dependent on human agents. As a consequence, AI systems cannot be held morally responsible, and responsibility attributions should take into account normative and social aspects involved in the design and deployment of the said AI. My argument falls in line with approaches critical of attributing moral agency to artificial agents, but draws from the philosophy of action, highlighting further philosophical underpinnings of current debates on artificial agency. Ideal theory in social and political philosophy generally works to hide philosophical theories’ complicity in sustaining the structural violence and maintenance of white supremacy that are foundational to settler colonial societies. While non-ideal theory can provide a corrective to some of ideal theory’s intended omissions, it can also work to conceal the same systems of violence that ideal theory does, especially when framed primarily as a response to ideal theory. This article takes a decolonial approach to exploring the limitations of (...) non-ideal theory in its ability to respond to and redress the continuing harms done to Indigenous peoples by settler colonialism, including by outlining non-ideal theory’s relationship to a colonial politics of recognition. Intersectionality is a term that arose within the black feminist intellectual tradition for the purposes of identifying interlocking systems of oppression. As a descriptive term, it refers to the ways human identity is shaped by multiple social vectors and overlapping identity categories (such as sex, race, class) that may not be readily visible in single-axis formulations of identity, but which are taken to be integral to robustly capture the multifaceted nature of human experience. As a diagnostic term, it captures the (...) confluence of power and domination on the social construction of identity in order to remedy concrete harms that result from this convergence. It is not a prescriptive methodology or closed system of analysis, but rather an open-ended hermeneutic lens through which interconnected systems of oppression can come into focus in the fight for social justice. This paper addresses the phenomenological experience of precarity and vulnerability in racialized gender-based violence from a structural perspective. Informed by Indigenous social theory and anti-colonial approaches to intergenerational trauma that link settler colonial violence to the modalities of stress-inducing social, institutional, and cultural violences in marginalized women’s lives, I argue that philosophical failures to understand trauma as a functional, organizational tool of settler colonial violence amplify the impact of traumatic experience on specific populations. It is trauma by design. I explore (...) this through the history of the concept of trauma and its connection to tragedy. I give a brief overview of prominent theories of trauma and contrast these with the work of Indigenous feminist scholar Dian Million (2013), who highlights functional complicity of settler colonial institutions in shaping accounts of trauma in the west. I begin the piece with an important illustration of the kinds of lives and experiences that call for a politicized understanding of trauma in anti-colonial feminist theory. I end by offering an expansive notion of structural trauma that is a methodological pivot for conducting trauma-based gender-based violence research in a decolonial context, which calls for an end to narratives of trauma that are severed from the settler colonial project of Native land dispossession and genocide. This chapter proceeds in two ways. First, I argue that Fanon’s structural witnessing of racism yields important insights about the nature of violence that challenges the settler colonial concept of violence as the extra-legal use of force. Second, I argue that his analysis of violence is insufficient for combating colonial racism and violence because, using the terms of his own analysis, it leaves intact logics and mechanisms that allow racism to structurally renew itself in perpetuity: violence against women. Without a (...) critical feminism that tracks the alterities of structural violence against women, and women of color in particular, Fanonianism is just another lifeline of colonialism. I thus caution against uncritical uses of Fanon’s structural account of violence for any emancipatory social theory that fails to acknowledge the attendant alterities, asymmetries, and axes of coordinated subordination involved in racialized violence against women. Since March 2020, many countries throughout the world have been in lockdown in response to the COVID-19 pandemic. In Italy, the quarantine began on March 9, 2020, and containment measures were partially reduced only on May 4, 2020. The quarantine experience has a significant psychological impact at all ages but can have it above all on adolescents who cannot go to school, play sports, and meet friends. In this scenario, this study aimed to provide a general overview of the perceived (...) risk related to COVID-19 and the psychological experience of quarantine in a large sample of Italian adolescents. 978 adolescents (males = 339; females = 639) living in 13 Italian regions and attending upper secondary school (age range: 13–20, M = 16.57, SD = 1.20), responded to an internet-based questionnaire about perceived health risk related to COVID-19, knowledge and information on measures to control the pandemic, beliefs and opinions on stage two of the quarantine, and psychological experiences related to quarantine. 31.1% of the participants lived in "red zones," which are places where the government has imposed stricter measures of containment due to exponential and uncontrolled growth in contagion cases compared to other areas in Italy. According to our results, Italian adolescents had a low perception of risk of COVID-19. Perceived comparative susceptibility and perceived seriousness were also very low. However, they were aware of the restriction measures necessary to contain the spread of the virus, and they agreed with the limitations imposed by the government. Females and adolescents living in a “red zone” showed more significant psychological negative feelings about the quarantine experience. However, no significant differences were found about the regions where the teenagers of our sample live and the other variables related to the COVID-19 experience. This is very interesting data, leading us to hypothesize that the participants' negative feelings may be more related to the adolescent period than to the pandemic itself. (shrink)

The trans-jurisdictional discourse on criminal justice is often hampered by mutual misunderstandings. The translation of legal concepts from English into other languages and vice versa is subject to ambiguity and potential error: the same term may assume different meanings in different legal contexts. More importantly, legal systems may choose differing theoretical or policy approaches to resolving the same issues, which sometimes – but not always – lead to similar outcomes. Grounded in stakeholder theory and a resource-based view of the firm, this longitudinal research demonstrates the evolution of corporate social responsibility (CSR) and firm reputation over time. Drawing on a 5-year sample of 285 major U.S. firms obtained from the KLD database and Fortune’s Most Admired Companies, we find that the proposed dynamic relationship predicts evolving stakeholder expectations to incite organizations to improve their social performance to earn reputational benefits. Contrary to the often labeled stickiness of reputation, we find a (...) “Red Queen” effect that supports reputation as a dynamic construct where the change in CSR does predict a change in corporate reputation. Similarly, we find that the change in reputation over time varies by industry, being most pronounced for manufacturing. From a practical perspective, this relationship across time may incite managers to create sustainable competitive advantage by continuously investing in doing good to reap the benefits of looking good and looking even better with time. By means of its Study Groups, international conferences and its periodicals, such as Minerva, the Congress developed into an influential forum for (...) examining the ways Big Science impacted the relations between science, society, and politics, thus constituting a semi-institutional niche for Science Studies before its professionalization within academia during the 1970s. I argue that the Congress contributed to the construction of public space in which the relations between science, society and politics were debated, and science was reconceptualized as a social activity. The vision of “science studies” the CCF-associated intellectuals promulgated was different from the science studies we know today. Yet, this alternative vision, in which the issues of science politics appeared inseparable from those of science policy, science organization, and science governance, constituted the “pre-history” of science studies today. This essay addresses structural violence against Latinas by looking at the existential toll different forms of cultural violence take on us. In particular, it looks at linguistic violence and the role lesser-known violences play in the intergenerational continuation of colonial violence, such as hermeneutic violence. Defined as violence done to systems of meaning and interpretation, hermeneutic violence is discussed at length in relation to the experience of harm and injury. The essay further explores some resistant epistemic practices Latina feminists have (...) generated to address systemic violence. In recent years, a ''change in attitude'' in particle physics has led to our understanding current quantum field theories as effective field theories (EFTs). The present paper is concerned with the significance of this EFT approach, especially from the viewpoint of the debate on reductionism in science. In particular, I shall show how EFTs provide a new and interesting case study in current philosophical discussion on reduction, emergence, and inter-level relationships in general.

One way to track the many critical impacts of women of color feminisms is through the powerful structural analyses of gendered and racialized oppression they offer. This article discusses diverse lineages of women of color feminisms in the global South that tackle systemic structures of power and domination from their situated perspectives. It offers an introduction to structuralist theories in the humanities and differentiates them from women of color feminist theorizing, which begins analyses of structures from embodied and phenomenological st¬¬andpoints--with (...) the day-to-day concerns of our lives. The essay is divided into three sections. In section one, I discuss theories of structure in the humanities and sciences, differentiating them from women of color’s analysis of structure as diagnostic of the ways colonial power relations are functionalized through social structures. In section two, I discuss the diverse contexts of interpretation that background women of color feminisms, outlining key themes and ideas related to theories of structure. I argue against a unified theory of women of color structural feminisms that supplants difference, favoring a rehabilitated concept of structure for the purposes of making targeted interventions in contemporary radical anti-colonial politics. I offer the example of systematic marginalization produced by colonial violence and mythology as one reason to take up this approach. In section three, I outline four provisional characteristics of women of color structural feminisms. I conclude that, when divested from colonial myths that guide mainstream notions of structure, it can be a useful hermeneutic tactic in the fight for liberation from ongoing colonial violence. What promised to be a refreshing addition to cumulative cultural evolution, by moving the focus from cultural transmission to technological innovation, falls flat through a lack of thoroughness, explanatory power, and data. A comprehensive theory of cumulative cultural change must carefully integrate all existing evidence in a cohesive multi-level account. We argue that the manuscript fails to do so convincingly.

Gender-based forms of administrative violence, such as reproductive violence, are the result of systems designed to enact population-level harms through the production and forcible imposition of colonial systems of gender. Settler statecraft has long relied on the strategic promotion of sexual and reproductive violence. Patterns of reproductive violence adapt and change to align with the enduring goals and evolving needs of settler colonial occupation, dispossession, and containment. The U.S. Supreme Court’s recent decision to end the constitutional right to abortion in (...) Dobbs v Jackson is but one instance of this larger pattern. We analyze reproductive and obstetric violence and the structural trauma they produce through the lenses of i) historical continuity and ii) the global architectures of neoliberal settler capitalism in order to connect reproductive rights rollbacks in the U.S. with the expansion of reproductive violence across a world connected by colonial globalization. Weak/strong duality is usually accompanied by what seems a puzzling ontological feature: the fact that under this kind of duality what is viewed as 'elementary' in one description gets mapped to what is viewed as 'composite' in the dual description. This paper investigates the meaning of this apparent 'particle democracy', as it has been called, by adopting an historical approach. The aim is to clarify the nature of the correspondence between 'dual particles' in the light of an historical analysis of (...) the developments of the idea of weak/strong duality, starting with Dirac's electric-magnetic duality and its successive generalizations in the context of field theory, to arrive at its first extension to string theory. This analysis is then used as evidential basis for discussing the 'elementary/composite' divide and, after taking another historical detour by analysing an instructive analogy case, drawing some conclusions on the particle-democracy issue. Naukovedenie (literarily meaning ‘science studies’), was first institutionalized in the Soviet Union in the twenties, then resurfaced and was widely publicized in the sixties, as a new mode of reflection on science, its history, its intellectual foundations, and its management, after which it dominated Soviet historiography of science until perestroika . Tracing the history of meta-studies of science in the USSR from its early institutionalization in the twenties when various political, theoretical and institutional struggles set the stage for the development (...) of the field, to the sixties when the field resurfaced within the particular political context of the Cold War, and using the history of Moscow Institute for the History of Science and Technology as a case-study, I situate Soviet naukovedenie project within the culture of late-socialism in the Soviet Union during the Cold War, asking what this discourse meant for its creators and practitioners, as well as for the high-ranked Soviet officials who provided the authoritative support for this field. In the wake of continued structural asymmetries between women of color and white feminisms, this essay revisits intersectional tensions in Catharine MacKinnon’s Toward a Feminist Theory of the State while exploring productive spaces of coalition. To explore such spaces, we reframe Toward a Feminist Theory of the State in terms of its epistemological project and highlight possible synchronicities with liberational features in women-of-color feminisms. This is done, in part, through an analysis of the philosophical role “method” plays in MacKinnon’s argument, (...) and by reframing her critique of juridical neutrality and objectivity as epistemic harms. In the second section, we sketch out a provisional coalitional theory of liberation that builds on MacKinnon’s feminist epistemological insights and aligns them with decolonizing projects in women-of-color feminisms, suggesting new directions and conceptual revisions that are on the way to coalition. This is the first of two papers concerned with the philosophical significance of dualities as applied in recent fundamental physics. The general idea is that, for its peculiarity, this ‘new’ ingredient in theory construction can open unexpected perspectives in the current philosophical reflection on contemporary physics. In particular, today’s physical dualities represent an unusual type of intertheory relation, the meaning of which deserves to be investigated. The aim is to show how discussing this point brings into play, at the same (...) time, what is intended by a 'theory’ and in which sense dualities are to be considered 'symmetries'. This paper is introductory and focusses on the first form of duality explicitly applied in twentieth century physics, that is electromagnetic duality as discussed in Dirac’s theory of magnetic poles. The extension of electromagnetic duality in the context of quantum field theory and string theory is explored in a forthcoming companion paper. (shrink)

This comment considers the Italian Law 194 on abortion forty years after its approval in 1978 and it focuses on how its meaning has emerged as a result of its interpretation and application over that forty-year period.

A macroscope is proposed and tested here for the discovery of the unique argumentative footprint that characterizes how a collective manages differences and pursues disagreement through argument in a polylogue. The macroscope addresses broader analytic problems posed by various conceptualizations of large-scale argument, such as fields, spheres, communities, and institutions. The design incorporates a two-tier methodology for detecting argument patterns of the arguments performed in arguing by an interactive collective that produces views, or topographies, of the ways that issues are (...) generated in the making and defending of standpoints. The design premises for the macroscope build on insights about argument patterns from pragma-dialectical theory by incorporating research and theory on disagreement management and the Argumentum Model of Topics. The design reconceptualizes prototypical and stereotypical argument patterns for characterizing large-scale argumentation. A prototype of the macroscope is tested on data drawn from six threads about oil-drilling and fracking from the subreddit Changemyview. The implementation suggests the efficacy of the macroscope’s design and potential for identifying what communities make controversial and how the disagreement space in a polylogue is managed through stereotypical argument patterns in terms of claims/premises, inferential relations, and presentational devices. The paper argues in favour of a direct realist reading of Aquinas’s theory of intelligible species, in opposition to the recent representationalist challenges. In order to secure the direct realist reading, the paper follows three steps: a short description of Aquinas’s process of cognition, a survey of the direct realist arguments and the analysis of the representationalist interpretation. The final step consists of investigating the representationalist reading as it is suggested by two scholars, Claude Panaccio in Aquinas on Intellectual Representation (...) and Robert Pasnau in Theories of Cognition in the Latter Middle Ages. Thus, the paper can be construed as a reply to these two authors, due to the thorough attention paid to their argumentative trails. With regard to Panaccio’s reading the paper focuses on the identity between the intelligible species and the essence of the extra-mental object and argues that Panaccio understands identity in a very narrow sense. Concerning Pasnau’s line of reasoning the focus is on the primum cognitum status of the intelligible species, and the main argument is that intelligible species is understood by Aquinas as the quo and not the quod of cognition. As the paper shows, neither one, nor the other interpretation poses a threat to the direct realist reading of Aquinas’s intelligible species. (shrink)
